Terms of Use

Effective date: November 10, 2025

These Terms of Use (“Terms”, “Agreement”) are a binding agreement between you (“you”, “User”) and Victory Plus, Inc. (“Victory+ News”, “Victory+”, “Company”, “we”, “us”, or “our”). These Terms govern your access to and use of the Victory+ News websites, mobile web experiences, email newsletters, notifications, interactive data modules and embedded widgets (including Sportradar-powered components), and related pages we control (collectively, the “Services”).

PLEASE READ CAREFULLY. BY ACCESSING OR USING THE SERVICES, YOU AGREE TO THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE, DO NOT USE THE SERVICES. CERTAIN FEATURES MAY BE SUBJECT TO ADDITIONAL TERMS; YOUR USE OF THOSE FEATURES CONSTITUTES ACCEPTANCE OF THE ADDITIONAL TERMS.

ARBITRATION & CLASS ACTION WAIVER. EXCEPT FOR CLAIMS RELATING TO INTELLECTUAL PROPERTY, YOU AGREE THAT DISPUTES WITH US WILL BE RESOLVED BY BINDING ARBITRATION ON AN INDIVIDUAL BASIS, WITH A CLASS ACTION WAIVER, AS DESCRIBED BELOW.

1) Who We Are; Relationship to Victory+

Victory+ News is operated by Victory Plus, Inc., in coordination with A Parent Media Co. Inc. (“APMC”). Victory+ News is the stats-first editorial companion to Victory+. While integrated with the broader Victory+ ecosystem (including deep links to streams and cross-surface personalization), Victory+ News is a distinct, editor-led product with its own policies and experiences.

2) Eligibility; Territory

You must be at least 18 years old to use the Services. Certain features, modules, or links may be geo-restricted or unavailable in your location (e.g., rights/blackouts, sponsored or betting context). You are responsible for complying with local laws in the place you access the Services.

3) Changes to These Terms

We may change these Terms at any time in our discretion. When we do, we will update the “Effective date” above. Changes are effective when posted and apply to use thereafter. Your continued use constitutes acceptance. If a change is material, we will provide reasonable advance notice (e.g., prominent notice on the Services and/or email).

4) Privacy

Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Services, you consent to our data practices consistent with the Privacy Policy and applicable law.

5) License to Use the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use the Services for your personal, non-commercial use. We reserve all rights not expressly granted.

  1. Restrictions. You will not:
    copy, modify, or create derivative works of the Services or any content;
  2. reverse engineer, decompile, or attempt to access source code;
  3. remove or alter proprietary notices;
  4. rent, lease, sell, or sublicense the Services;
  5. use any data from the Services (including stats, articles, UI, or underlying datasets) to train, test, benchmark, or improve any AI/ML model or for any automated scraping, harvesting, or similar purpose;
  6. bypass or interfere with security or rights management features; or
  7. use the Services in any unlawful or infringing manner.

6) Content and Ownership

The Services include editorial content, data modules (e.g., box scores, live game trackers, win probability, standings), graphics, text, images, logos, design, look and feel, and software (collectively, “Content”). Content is owned by Victory+, its affiliates, licensors, or partners (including Sportradar and league/team partners), and is protected by intellectual property and other laws.

Except as expressly allowed in Section 5, you may not reproduce, distribute, publicly display, publicly perform, or create derivative works from the Content. You may print or download one copy of a reasonable number of pages for personal, non-commercial use, provided you keep all proprietary notices intact.

Trademarks. “Victory+,” “Victory+ News,” our logos, and all related names and marks are trademarks of Victory+ or its affiliates. Third-party names and marks are the property of their respective owners.

7) Third-Party Services; Data Providers; Sponsors

The Services integrate third-party materials, including Sportradar data/widgets, analytics, advertising technologies, social embeds, and sponsored placements (“Third-Party Materials”). Third-Party Materials are provided for convenience; we do not control and are not responsible for their content, availability, or practices. Your use of Third-Party Materials may be governed by third-party terms and privacy policies.

Sponsored and branded modules (e.g., “Presented by …”, “Stat of the Game”) are paid placements. Sponsorship does not constitute our endorsement of a sponsor’s products or services.

8) Informational Only; No Advice

The Services provide editorial and statistical information for entertainment and informational purposes. Where permitted, we may display limited betting/fantasy context (e.g., odds, probabilities, player comparisons). We do not provide betting, financial, legal, or medical advice, and we do not recommend or endorse any wagers or outcomes. You are solely responsible for how you use information on the Services.

9) Accounts; Security (If Offered)

Some features (e.g., newsletters, follows/personalization, comment features if enabled now or in the future) may require or permit an account. You agree to provide accurate information, keep your credentials confidential, and promptly notify us of unauthorized use. Your account is personal to you. We may suspend or terminate access for any violation of these Terms or for risk to users, partners, or our systems.

10) User Contributions (If Enabled)

If the Services enable posting (e.g., comments, forums, UGC) (“User Contributions”):

  • License. You grant us and our affiliates a worldwide, royalty-free, perpetual, irrevocable license to use, host, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your User Contributions in any media, with the right to sublicense.
  • Standards. User Contributions must comply with law and must not be unlawful, defamatory, obscene, harassing, hateful, infringing, deceptive, or otherwise objectionable; must not contain advertising, spam, malware, or personal data of others; and must not misrepresent your identity.
  • Enforcement. We may remove or refuse to post User Contributions and may disclose your identity to third parties asserting rights. We do not undertake to review all material before posting and are not responsible for third-party content.

11) Prohibited Uses

You will not use the Services to:

  • violate any law, regulation, or league/team policy;
  • exploit, harm, or attempt to harm minors;
  • transmit spam or unsolicited communications;
  • impersonate or misrepresent your affiliation;
  • engage in scraping, automated collection, or systematic extraction of data (including for AI/ML purposes);
  • introduce malware or interfere with security; or
  • attempt to gain unauthorized access to any systems or data.

12) Access; Availability; Modifications

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We do not guarantee the Services will be uninterrupted or error-free. Certain content may be delayed, incorrect, or withdrawn. We are not liable for any unavailability or modification.

13) Feedback; Usage Data

If you provide feedback, ideas, or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation. We may collect and use de-identified usage/diagnostic data to maintain, secure, and improve the Services.

14) DMCA / Copyright

If you believe content on the Services infringes your copyright, notify our agent:

Include: (a) your signature; (b) identification of the copyrighted work; (c) identification of the infringing material and its location; (d) your contact information; (e) a statement of good-faith belief; and (f) a statement that your notice is accurate and you are authorized to act.

15) Disclaimers

THE SERVICES AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, DATA PROVIDERS (INCLUDING SPORTRADAR), LEAGUE/TEAM PARTNERS, AND SERVICE PROVIDERS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND FREEDOM FROM MALICIOUS CODE OR INTERRUPTIONS. WE DO NOT WARRANT THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE ERROR-FREE OR THAT ERRORS WILL BE CORRECTED.

Some jurisdictions do not allow the exclusion of certain warranties; some exclusions may not apply to you.

16) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR AFFILIATES, LICENSORS, DATA PROVIDERS (INCLUDING SPORTRADAR), LEAGUE/TEAM PARTNERS, SPONSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY.

OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID (IF ANY) SPECIFICALLY TO USE THE SERVICES DURING THE SIX (6) MONTHS BEFORE THE CLAIM AROSE.

Some jurisdictions do not allow certain limitations; some limitations may not apply to you.

17) Indemnification

You will defend, indemnify, and hold harmless Victory+, its affiliates, licensors, data providers, sponsors, and service providers, and their respective officers, directors, employees, and agents from and against claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Contributions; (c) your violation of these Terms; or (d) your violation of any law or third-party right.

18) Governing Law; Venue

These Terms and any dispute related to the Services are governed by the laws of the State of Texas, without regard to conflict of laws rules.

19) Arbitration; Class Action Waiver

At our sole discretion, any dispute arising from or relating to these Terms or the Services (including interpretation, breach, validity, or termination) shall be submitted to final and binding arbitration under the American Arbitration Association rules, applying Texas law. YOU AND WE WAIVE ANY RIGHT TO BRING CLAIMS AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION. Judgment on the award may be entered in any court of competent jurisdiction.

You may seek relief in small-claims court if your claims qualify.

20) Export; Sanctions; U.S. Use

You represent that you are not located in a country embargoed by the United States and are not on any U.S. government list of prohibited or restricted parties. You will comply with all applicable export and sanctions laws.

21) Termination; Suspension

We may suspend or terminate access to the Services (in whole or part) at any time, with or without notice, including for conduct that we believe violates these Terms, risks harm, or is otherwise inappropriate. Upon termination, your license ends and you must cease use and destroy any copies of materials obtained from the Services.

22) Links; Social Features

You may link to our homepage in a fair and legal manner that does not suggest endorsement or association. Framing, deep-linking to pages designed to be interactive modules, or linking in a manner that circumvents functionality or sponsorship is prohibited. We may disable links or social features at any time.

23) Severability; Waiver; Assignment

If any provision is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign freely.

24) Entire Agreement; Order of Precedence

These Terms, together with the Privacy Policy and any feature-specific terms (collectively, the “Entire Agreement”), are the complete agreement between you and us regarding the Services and supersede all prior or contemporaneous agreements on the subject. If there is a conflict, feature-specific terms govern that feature; otherwise these Terms control.
